July 20 Tip of the Week

The Department of Homeland Security, as they were expected to, extended its temporary relief measure for employers regarding the physical presence requirement for I-9 inspection through August 19, 2020.  This means that eligible employers can still inspect Section 2 documents remotely via video, fax or email.  Remember, this only applies to employers who are operating remotely and all employees who are onboarded remotely must provide in-person verification within three business days of when the business resumes normal operations.  It is expected that ICE will begin employer audits in earnest once workplaces begin to reopen.  Be sure that your company has a plan in place to reinstitute the typical I-9 verification process and be prepared to show that your company made a good faith effort to comply with all DHS rules during the pandemic.  Consult with our team of knowledgeable legal counsel to ensure your I-9 practices are compliant and audit-ready.
