Many states, the most recent of which is Oregon, impose a minimum wage requirement on employers seeking to bind employees to a noncompete. Oregon’s new law establishes a salary threshold prohibiting noncompetes with employees earning less than $100,533.00 annually. Illinois’ Freedom to Work Act outlaws noncompetes with low wage employees, which the law defines as individuals earning less than $13.00 per hour. Washington states’ own salary threshold for noncompete agreements is $100,000.00 per year.
