Now that the CDC has announced fully vaccinated people no longer need to mask at most indoor and outdoor locations, employers can be left wondering what that means for their employees.  First, the guidance only recommends that those who are fully vaccinated unmask, while implementing a sort of honor system for those who remain unvaccinated.  Second, the CDC still recommends that masks be worn in hospitals, prisons, public transportation including airplanes, homeless shelters and long-term care facilities.  Third, if other federal, state or local laws continue to require masks, then those laws will govern.  Last, businesses are free to continue to require mask wearing by both their employees and their customers.  While the end of the pandemic seems nearer by the day, the analysis of when masks are required or recommended is getting murkier.  If your company is considering scaling back your mask requirements, reach out to the attorneys at myHRcounsel for expert guidance on what is allowed and what is best practice.
